What are the obligations of a technician who accesses customer data?
Two, and neither is optional. On data protection, if you access, store or back up personal data on behalf of a business customer you are acting as a processor under UK GDPR: a written contract meeting Article 28 is required, and most controllers who process personal data must pay the annual data protection fee to the Information Commissioner's Office. On access itself, the Computer Misuse Act 1990 makes unauthorised access to computer material a criminal offence, and authorisation is limited to what the customer actually consented to — reading files, browsing photographs or copying data beyond the repair is an offence, not a lapse of etiquette. Get consent in writing for anything involving data recovery or transfer, and keep a record of what you accessed.
