Do you need rights to use music in a podcast?

Yes, and this is the gap almost everyone discovers late. TheMusicLicence from PPL PRS covers playing music in public and on hold — it does not cover podcasts. A podcast is a download and an on-demand service, which needs a synchronisation licence from the publisher for the composition and a master use licence from the label for the recording, negotiated directly, track by track. There is no blanket collective licence for it in the UK. In practice that is why studios and producers use production music libraries, royalty-free catalogues or commissioned music, all of which come with a written licence covering podcast use. Put it in your terms: the client warrants they hold the rights to anything they bring.
